Why it matters

What you do in the next 48 hours can decide how this ends.

Most people who call us have never been in trouble with the law before. They are stressed, unsure how the process works and tempted to wait and see. That is usually when small problems become serious ones.

01

Talking to police without advice

An informal chat can become the evidence against you. You have the right to get legal advice before you say anything.

02

Letting a deadline slip

Court dates, licence appeal periods and claims against an estate all run to strict timeframes. Miss one and your options shrink, sometimes for good.

03

Ignoring the notice

A court attendance notice, a licence suspension letter or a notice about an estate will not go away. Left unanswered, it can mean a conviction in your absence or losing your right to make a claim.

The sooner you get advice, the more options you keep. Call us on 02 4910 4054.

Practice areas

Three areas of law. Experienced advocacy in your corner.

01 / Criminal law

Charged, or under police investigation?

From assault, drug and AVO matters through to serious charges before a jury, we prepare every matter as though it is going to hearing. That preparation is what gets charges reduced, withdrawn or successfully defended.

Assault · AVOs · Drug offences · Serious charges · Sentencing · Appeals

02 / Traffic law

About to lose your licence?

Drink driving, speeding, driving while suspended and licence appeals. Losing your licence can cost you your job, so we work to keep you on the road wherever the law allows. We present regularly at the Traffic Offenders Program.

03 / Wills & Estates Litigation

Left out of a Will, or defending an estate?

When a Will leaves someone out, or an estate is being challenged, the outcome turns on evidence and deadlines. We act in Family Provision claims and estate disputes, and have secured provision for widows and children in exactly that situation.

Common questions

What people ask us first.

Every matter is different, so the best answer is a conversation. These are the questions we hear most often.

How much will it cost?

It depends on the matter, which is why we explain the likely costs at the start, before any work begins. You will know where you stand financially from day one, with no surprises.

Should I talk to police before getting legal advice?

You have the right to get legal advice before taking part in a police interview. What you say can be used as evidence, so in almost every case it is wise to speak to a lawyer first. Call us before you go in.

My court date is soon. Is it too late?

Usually not. We regularly take on matters at short notice, including court appearances only days away. The sooner you call, the more time we have to prepare, so do not wait.

Which courts and areas do you cover?

We appear in the Local, District and Supreme Courts of NSW, and act for clients across Newcastle, the Hunter, the Central Coast, Sydney and the Mid North Coast.

Who will handle my matter?

An experienced lawyer, from start to finish. Duncan & Co is a boutique firm by design, so the lawyer you speak to on the first call is the lawyer who runs your matter.

Talk to us today

You don't have to face this alone.

The sooner you call, the more options you keep. Tell us what has happened and we will tell you, honestly, where you stand and what to do next.
